Terms of Service
Last updated: October 23, 2026
1. Acceptance of Terms
Welcome to LeadRescue ("Service", "Platform", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is intended for business (B2B) use by business owners and their authorized representatives.
2. Description of the Service
LeadRescue is a SaaS platform that helps businesses recover abandoned leads and shopping carts through AI-generated automated WhatsApp messages, and create proposals that can be digitally signed and paid online. The Service includes integration with external webhooks (such as Shopify, WooCommerce, and Elementor Forms), third-party messaging services (WhatsApp), and payment processing through external payment providers.
3. User Accounts
Registering for the Service requires providing accurate and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription Plans, Free Trial & Payment
The Service is offered in various plans (including a time-limited free trial), as described on the pricing page and in your account settings. At the end of the trial period, you may need to upgrade to a paid plan to continue enjoying the full features of the Service. Payments are processed through an external payment provider (Stripe and/or an authorized local payment provider); we do not store full credit card details on our servers.
5. Acceptable Use
When using the Service, you agree not to:
- Send spam, unsolicited marketing messages, or messages that violate WhatsApp's/Meta's usage policies.
- Use the Service for unlawful activity, harassment, fraud, or any violation of applicable law in Israel or any other country.
- Scrape, data-mine, or collect information without authorization — whether from the Service itself or through it against third parties.
- Upload content that is abusive, misleading, or infringes a third party's intellectual property rights.
- Attempt to circumvent security measures, overload the infrastructure, or reverse-engineer the Service.
Violating this section may result in immediate suspension or termination of your account, without refund, and without prior notice in severe cases.
6. Third-Party Services
The Service integrates with and relies on third-party services, including WhatsApp messaging providers (such as GreenAPI or Twilio, and the underlying WhatsApp Business API operated by Meta), infrastructure and database providers (Supabase), and payment processors (Stripe and others). These services are governed by their own terms of use and privacy policies, and we are not responsible for their availability, policy changes, or any action they take — including blocking, restricting, or suspending a WhatsApp Business account by Meta/WhatsApp, which is outside our control.
7. Your Content
You retain ownership of the content you submit through the Service — including lead information, proposals, and branding assets. By submitting content, you grant us a limited license to process, store, and transmit it solely for the purpose of providing the Service to you (for example, sending a WhatsApp message to your lead on your behalf, or generating a proposal PDF).
8. Service Provided "AS IS"
The Service is provided "AS IS" and "AS AVAILABLE", without any warranty — express or implied — of continuous 100% availability, uninterrupted operation, or complete correctness at all times. We do not guarantee that messages sent through the Service will reach their destination, be delivered, or be read by the recipient — WhatsApp message delivery depends entirely on the availability, policies, and proper functioning of the third-party providers described above.
9. Limitation of Liability
To the maximum extent permitted by law, LeadRescue, its owners, employees, and operators shall not be liable for any indirect, consequential, incidental, special, or punitive damages — including but not limited to: loss of revenue, loss of leads or deals, loss of data, business interruption, or any damage arising from the suspension, blocking, or restriction of a WhatsApp Business account or payment account by a third party (including Meta/WhatsApp or the payment provider) — even if we were advised of the possibility of such damages. Our total liability to you, in any case, shall not exceed the amount you paid us in the six months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold LeadRescue, its owners, employees, and operators harmless from any claim, damage, liability, or expense (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any applicable law or third-party right — including claims arising from messages you send through the Service.
11. Intellectual Property
All rights in the Service, including code, design, trademarks, and content, belong to LeadRescue and are protected under copyright and intellectual property law. You are granted a limited, personal, non-transferable license to use the Service in accordance with these Terms only. Content you upload (lead details, proposals, branding) remains your property.
12. Termination
We may suspend or terminate your access to the Service at any time, subject to law, in the event of a violation of these Terms. You may stop using the Service and cancel your account at any time through your account settings or by contacting us.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after a change is published constitutes acceptance of the updated Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Israel, and the courts of the Tel Aviv-Jaffa district shall have exclusive jurisdiction over any dispute relating to the Service — regardless of the country from which you access or use the Service.
15. Contact
For questions about these Terms, you may contact us through the contact details on our website or in the Service's settings page.
